1. Agreement to these terms
These Terms of Use govern your access to and use of jasonluke.ca (the “Site”), operated by Jason Luke, a REALTOR® licensed in British Columbia with RE/MAX Core Realty(“we”, “us”, or “our”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
2. Informational purposes only
Content on this Site — including neighbourhood guides, market reports, calculators, blog posts, and listing information — is provided for general information. It is not legal, tax, or financial advice. Before making any real estate decision you should consult a licensed real estate professional, a lawyer, and a mortgage broker or financial advisor.
Mortgage and affordability calculators on this Site produce estimates only. Actual rates, payments, and qualification depend on the lender, your credit, down payment, and insurance requirements. No result produced by a calculator on this Site is a quote or an offer of financing.
3. Listing data and MLS® content
Listing data on this Site is provided through the Canadian Real Estate Association (CREA) Data Distribution Facility (DDF®) and sourced from the BC Northern Real Estate Board (BCNREB) and participating Canadian real estate boards.
Listing information is deemed reliable but is not guaranteed accurate. Square footage, tax amounts, strata fees, lot dimensions, and property features are provided by the listing brokerage and may contain errors. Before you act on any listing information, verify it independently (city records, title search, home inspection, appraisal) and speak with Jason.
The trademarks MLS®, Multiple Listing Service®, and REALTOR® are owned by CREA and identify services provided by real estate professionals who are members of CREA.
4. Acceptable use
You agree not to:
- Scrape, spider, harvest, or otherwise automate collection of listing data from this Site. MLS® listing data is licensed to us and may not be redistributed.
- Use the Site to transmit spam, malware, or any material that violates law or a third-party's rights.
- Reverse-engineer, decompile, or attempt to circumvent any security mechanism on the Site.
- Use the Site to impersonate Jason Luke or RE/MAX Core Realty, or to suggest an endorsement that has not been given.
We may suspend or terminate your access if we reasonably believe you have violated these terms.
5. VOW registration and saved searches
Some features (saved listings, sold data, alerts) require you to register and agree to a Virtual Office Website (VOW) terms of use in addition to these terms, as required by CREA and BCNREB rules. You are responsible for keeping your account credentials confidential and for activity that occurs under your account.
VOW passwords expire every 30 days in accordance with board rules. Inactivity, violation of VOW terms, or scraping attempts may result in your account being terminated.
6. Intellectual property
Original content on this Site — including photographs, written neighbourhood guides, market commentary, and design elements — is owned by or licensed to Jason Luke and is protected by Canadian copyright law. You may view, print, and share this content for your personal, non-commercial use. You may not reproduce, republish, or use it for a commercial purpose without written permission.
MLS® listing data and photographs are the property of the listing brokerage and are subject to CREA and BCNREB rules.
7. Third-party links and services
The Site includes links to third-party websites (government resources, REALTOR.ca®, BCFSA, mortgage lenders). We do not control those sites and we are not responsible for their content, privacy practices, or availability.
8. No warranty
The Site is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of data. We do not warrant that the Site will be uninterrupted, secure, or free of errors.
9. Limitation of liability
To the maximum extent permitted by law, Jason Luke and RE/MAX Core Realty are not liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Site or reliance on information on the Site. Our total liability arising from your use of the Site will not exceed one hundred Canadian dollars (CA$100).
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or obligations under the Real Estate Services Act and related regulations.
10. Indemnity
You agree to indemnify and hold harmless Jason Luke and RE/MAX Core Realty from any third-party claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Site or breach of these terms.
11. Governing law and dispute resolution
These terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. Any dispute will be resolved in the courts of British Columbia in Prince George or Vancouver, unless applicable consumer protection law gives you the right to sue where you live.
12. Changes
We may update these terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the revised terms.
